These Terms of Use (“Terms”) govern your access to and use of the website 887-smile.com (the “Site”) and all related communications and services provided by Dental Solutions LLC, doing business as Smile Dental (“Smile Dental,” “we,” “us,” or “our”), located at 1211 E. Bennett St., Springfield, MO 65804. This includes, but is not limited to, website interactions, email, RCS chat, SMS, MMS, phone calls, and in-person communications (collectively, the “Services” and “Communications”).

By accessing the Site, communicating with us through any channel, signing up for messaging services, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or communicate with us through these channels.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services or provide consent for communications. By interacting with us or providing contact information, you represent that the information you provide is accurate and that you have the legal right to use any phone number or email address submitted.

2. Consent to Communications

By providing your contact information (phone number, email, etc.) or opting in through the Site or other means, you consent to receive communications from Smile Dental via any of the following channels: website forms, email, RCS, SMS, MMS, phone calls, and in-person conversations. These may include appointment reminders, confirmations, follow-ups, practice updates, billing notices, and other communications related to our dental services.

  • Message frequency varies depending on the channel and your interactions with the practice.
  • Standard message and data rates may apply for text-based messages.
  • You may opt out of text messaging (RCS/SMS/MMS) at any time by replying STOP. For email, use the unsubscribe link when available or contact the office.
  • For help with messaging, reply HELP or contact us directly.
  • Consent to receive communications is not a condition of receiving dental treatment or purchasing services.

Delivery of electronic messages depends on your carrier, device, and email provider.

3. Medical Disclaimer

All Communications and content on the Site are for general informational and administrative purposes only (such as scheduling, reminders, and basic practice information).

They do not constitute dental, medical, or professional advice, diagnosis, or treatment. Nothing on the Site or in any Communication creates a dentist-patient relationship by itself.   • These electronic channels may not be encrypted end-to-end and could potentially be intercepted or accessed by unauthorized parties.
  • Phone calls and in-person conversations are generally more controlled environments, but you should still use discretion when discussing sensitive information in public or overheard settings.
  • For the most secure transmission of PHI, please use our designated patient portal (if available), discuss information during an in-office visit, or call the office directly at 417-887-7645 and speak with a staff member.

By communicating with us through any channel, you acknowledge that you understand these limitations. Any information you voluntarily share through unsecured methods is done at your own risk. We will handle any PHI we receive in a manner consistent with our Notice of Privacy Practices and applicable HIPAA requirements. We strongly recommend against using unsecured electronic channels for sensitive health information.

5. Acceptable Use

To the maximum extent permitted by law, Smile Dental and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of (or inability to use) the Site, Services, or any Communications, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms, the Services, or Communications shall not exceed one hundred dollars ($100).

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

9. Indemnification

You agree to indemnify, defend, and hold harmless Smile Dental and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, Services, or Communications, your violation of these Terms, or your violation of any rights of another.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, the Services, or Communications shall be resolved exclusively in the state or federal courts located in Greene County, Missouri (or the appropriate federal district), and you consent to personal jurisdiction there.
